A press release was sent out on May 1, outlining allegations of sexual assault by a Strathmore RCMP officer.
A statement of claim was filed against the RCMP detachment and the constable in question. The claim alleges that on Dec. 21, 2012 the female victim was being driven home by the constable, and was forced to strip and perform oral sex on the officer.
The Alberta Serious Incident Response Team (ASIRT) is investigating the case, and an internal investigation is also being done by the RCMP.
Clint Docken, counsel for the victim, questions why nothing has happened with the case in the year since the woman was first questioned about the incident.
“Our understanding is the investigation is still outstanding, although for whatever reason they have decided that no criminal charges are appropriate. Which isn’t unusual, that happens virtually all of the time,” said Docken.
“We’re just looking for some accountability, and the accountability hasn’t come to this point in time in terms of the investigations. The claim was filed as a last resort and (the victim) wants her situation dealt with. She’s concerned that there are going to be other potential victims out there.”
Docken said his client reached out to his office for help in January of 2013, shortly after the alleged incident took place.
“She’s not doing that well, she is under medical treatment. It had a pretty significant effect on her and to this day she is still experiencing repercussions,” said Docken.
The next step for Docken and his client is to file a statement of defence, and then the matter will proceed to questioning. If the matter doesn’t get resolved it will go to trial.
“In terms of our experience with the RCMP there doesn’t appear to be any inclination to resolve these matters, so we’re anticipating it to go to trial,” said Docken.
Staff Sgt. Kevin Reilly’s only comment about the matter is that the member is suspended with pay, and has been since the RCMP were first advised of the incident.
